Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Qalizer, an automated quality-assurance platform.

1. Agreement and Eligibility

By creating an account or using Qalizer, you confirm that you are at least 16 years old (or the minimum age required in your jurisdiction), have read and understood these Terms, and agree to be bound by them. If you use Qalizer on behalf of a company, you represent that you have authority to bind that company.

2. Qalizer Service Description

Qalizer provides an automated quality assurance platform including website crawling, AI-powered test generation, scenario recording and replay, visual regression testing, liveness monitoring, API testing, load testing, console/network analysis, data injection, reports, and related features (the “Service”).

3. Account Responsibilities

You must provide accurate information when registering and keep your account details up to date.
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
You must notify us immediately of any unauthorized use of your account.

4. Authorization Requirement

You may use Qalizer to test, crawl, load-test, or otherwise analyze only systems you own or are expressly authorized to test. You are solely responsible for:

Obtaining any required permission from the owner of a target system before running tests.
Ensuring your testing complies with the target's terms of service and applicable law.
Not using the Service to perform unauthorized scanning, crawling, load testing, or security testing.

5. User Responsibility for Content

You are responsible for the URLs, credentials (where you provide them for form testing), test data, uploaded requirements, scenarios, reports, and any interactions with third-party systems through the Service. You must not upload data you do not have the right to process.

6. Acceptable Use and Prohibited Activities

You agree not to:

Circumvent rate limits, access controls, or authentication mechanisms.
Use the Service to conduct denial-of-service attacks or other abusive testing.
Upload malicious content, attempt to gain unauthorized access, or abuse AI features.
Resell or sublicense the Service without written permission.
Test systems owned by third parties without their authorization.

7. AI-Generated Analysis and Verification

Qalizer may provide AI-assisted analysis of test results, AI-generated test scenarios, and AI report verification. This analysis is advisory only and may be inaccurate. Runner results remain authoritative. You should review and verify AI output before acting on it.

8. Reports and Test-Result Limitations

Test results and reports reflect the state of the tested system at the time of execution. They may be affected by network conditions, third-party services, timing, or changes made after the test. Reports do not guarantee that software is free of defects.

9. Scheduled Testing Limitations

Scheduled testing runs according to your configuration and our operational capacity. We do not guarantee that every scheduled run will execute at the exact configured time, and scheduled testing may be delayed, skipped, or suspended during maintenance or capacity constraints.

10. Credits

Credits are usage units for the Service. Each action (crawl, test run, load test, etc.) consumes a configured number of credits.
Current credit costs are shown before you perform an action. Credit pricing is set by the server-authoritative pricing engine and may change over time.
Credit purchases are processed through Stripe where enabled. You may also receive promotional or granted credits under applicable rules.
Refunds are handled according to our current refund policy, which may be limited. Unused promotional credits are not refundable.

11. User Content Ownership

You retain ownership of your content, including test data, scenarios, requirements, and reports. By using the Service, you grant Qalizer a limited, non-exclusive license to process, store, and display your content solely to provide the Service and as described in these Terms.

12. License Qalizer Needs

To provide the Service, Qalizer needs a limited license to your content — to run your tests, generate reports, process your requirements, and deliver results to you. This license does not give Qalizer ownership of your content and does not permit use outside of providing the Service.

13. Qalizer Intellectual Property

The Qalizer platform, including its code, UI, branding, and any product-specific documentation, is owned by Qalizer and protected by applicable intellectual-property laws. Your content remains yours as described in Section 11.

14. Blog Content and Links

Our blog may contain articles, links, and product information for general informational purposes. Blog content does not constitute professional, legal, or technical advice, and links to third-party sites do not constitute endorsement.

15. Third-Party Services

The Service may integrate with third-party services (such as Stripe for payments, cloud providers for hosting, AI providers, and SMTP for email). These third parties have their own terms and policies. Qalizer is not responsible for third-party services.

16. Service Availability and Changes

The Service is provided “as available.” We may modify, suspend, or discontinue features, change pricing, or update the Service from time to time. We do not guarantee uninterrupted or error-free availability.

17. Suspension and Termination

We may suspend or terminate your account for material breach of these Terms, unauthorized or abusive use, or as required by law. You may cancel your account at any time from your profile settings.

18. Account Deletion

When you delete your account, access to the Service is removed. Data associated with your account is handled as described in the Privacy Policy. Some data may be retained for legal or security reasons.

19. Warranty Disclaimer

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or meet your specific requirements. Test results are provided for informational purposes and are not guaranteed.

20. Limitation of Liability

To the maximum extent permitted by law, Qalizer's aggregate liability for any claim related to these Terms or your use of the Service shall not exceed the amount you paid us in the three months preceding the claim, or a minimal statutory amount if permitted. We are not liable for indirect, incidental, or consequential damages.

21. Indemnity

You agree to indemnify and hold Qalizer harmless from claims arising out of your use of the Service, your violation of these Terms, or your violation of the rights of a third party. This section applies only where legally permissible.

22. Governing Law and Disputes

Configuration needed: set LEGAL_GOVERNING_LAW and LEGAL_COUNTRY to specify the governing law and jurisdiction.

23. Terms Changes

We may update these Terms from time to time. The “Last updated” date reflects the latest revision. Continued use of the Service after an update constitutes acceptance of the revised Terms. We will try to notify registered users of material changes.
